1. Acceptance of Terms
By accessing or using the 9WAK platform, including 9WAK Music, 9WAK Image, and any affiliated applications or APIs (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must discontinue use of the Service immediately.
2. Accounts, Authentication & Cookies
Access to generation features requires a valid 9WAK account authenticated via our identity provider (Supabase Auth).
- You are responsible for safeguarding your session tokens, credentials, and API keys.
- We utilize secure domain cookies (such as
auth_token) to coordinate single sign-on across 9WAK platform subdomains. - Any activity originating from your account or session credentials will be deemed your responsibility.
3. Credit System, Billing & Deductions
Generations are metered through a non-refundable digital AI credit balance linked to your 9WAK profile.
- Deduction upon Completion: Credits are verified prior to job processing and deducted upon successful generation and delivery of media assets.
- Failed Operations: In the event of a verified server error or timeout, credits are not deducted. Generations blocked due to content policy violations (Responsible AI filters) may still be subject to credit deductions to offset compute costs.
- No Cash Value: Credits have no independent monetary value, cannot be redeemed for legal tender, and are non-transferable between accounts.
4. AI Generations & Third-Party Infrastructure
The Service leverages Google Cloud Vertex AI foundation models (including Lyria, Imagen, and Veo models) as well as Google Cloud Storage (GCS) for temporary and permanent asset hosting.
- Nature of AI Output: Outputs generated by artificial intelligence are probabilistic. 9WAK makes no guarantees regarding the originality, quality, accuracy, fidelity, or artistic merit of generated sound, music, stingers, or imagery.
- Model Availability: Underlying AI models and compute endpoints are governed by provider quotas and availability. Delays, backoffs, or temporary rate limits may occur.
5. Acceptable Use & Prohibited Prompts
You agree not to submit prompts, images, or audio parameters that:
- Violate Google’s Responsible AI (RAI) safety guidelines and prohibited use policies.
- Generate or solicit explicit adult content, non-consensual sexual imagery, child exploitation, harassment, or hate speech.
- Infringe upon existing third-party copyrights, trademarks, publicity rights, or intellectual property rights.
- Impersonate living individuals without legal consent or generate deceptive political/disinformation material.
- Attempt to reverse engineer, scrape, bypass rate limiters, or trigger denial-of-service conditions against our endpoints.
9WAK reserves the right to terminate access immediately and without notice for accounts exhibiting abusive prompting patterns or intentional safety filter evasion.
6. Intellectual Property & Media Rights
As between you and 9WAK, you retain any rights you hold in your input text prompts. To the maximum extent permitted by applicable copyright law and Google Cloud platform terms, you are granted rights to download and use the generated audio, music, and images created through your paid credit balance.
You grant 9WAK a worldwide, non-exclusive, royalty-free license to store, process, encode, and transmit your inputs and generated outputs solely for the purposes of operating, maintaining, and improving the Service.
7. Storage, Signed Links & Retention
Generated files are stored on cloud storage buckets and accessed via time-limited signed URLs (typically expiring within 15 to 60 minutes). 9WAK does not guarantee indefinite archival storage for generated files. You are encouraged to download your generated audio and media assets promptly.
8. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. 9WAK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
9. Modifications & Contact
We reserve the right to revise these Terms and credit pricing schedules at our discretion. Continued use of 9WAK following posted modifications constitutes acceptance of the amended Terms.
